SMS/Text Messaging Terms & Conditions

These SMS/Text Messaging Terms & Conditions (“Terms”) govern your use of the SMS/text messaging services (the “SMS Service”) offered by Hjerpe Law, Inc. (“Hjerpe Law,” “we,” “us,” or “our”). By opting in to receive SMS/text messages from us, you agree to these Terms.

Please read these Terms carefully. They supplement, but do not replace, the terms of any Engagement/Legal Services Agreement you may have with us.


1. Program Description – Types of Messages

With your consent, Hjerpe Law may send SMS/text messages to your mobile phone number for purposes related to our legal services, including but not limited to:

  • Appointment scheduling and appointment reminders
  • Intake and consultation confirmations
  • Case or matter status updates and general notifications
  • Requests for information or documents related to your matter
  • Document‑signature or portal login reminders
  • Billing and payment notices or reminders
  • Limited informational notices about our services, events, or legal updates, where permitted by law

We do not use SMS/text messaging to send unrelated third‑party marketing messages.


2. How to Opt In

You may opt in to receive SMS/text messages from Hjerpe Law in one or more of the following ways:

  • Providing your mobile phone number on an intake form, web form, or other document and expressly consenting to receive SMS/text messages from us;
  • Responding “YES” or similar affirmative keyword to an opt‑in message from us, where applicable; or
  • Providing written or electronic consent in an Engagement/Legal Services Agreement that includes SMS/text communication terms.

Your consent to receive SMS/text messages is not a condition of hiring Hjerpe Law or receiving legal services. However, certain communications (such as appointment reminders or time‑sensitive updates) may be more efficient via SMS, and opting out of SMS may require us to contact you via alternative methods.


3. Message Frequency

Message frequency may vary. The number of messages you receive will depend on your relationship with us and the nature and status of your legal matters, including:

  • The number of active matters or appointments you have with us
  • The amount of information needed to handle your matter
  • Whether you have opted in to receive additional informational updates

We strive to send only messages that are reasonably necessary or helpful in connection with our representation or your requests.


4. Message and Data Rates

Message and data rates may apply. You are responsible for any charges from your mobile carrier resulting from SMS/text messages sent to or from your mobile device, including messages from us and your replies.

Please contact your mobile carrier for information about your text messaging plan and any associated charges.


5. How to Opt Out

You may opt out of receiving SMS/text messages from Hjerpe Law at any time by:

  • Replying STOP to any SMS/text message you receive from us; or
  • Contacting us using the information in Section 10 below and requesting that we remove your mobile number from our SMS Service.

After you send STOP, we may send you a confirmation message to verify that you have been unsubscribed. After this, you will no longer receive SMS/text messages from us at that number, except where messages are required for legal, regulatory, or emergency reasons (if applicable).

Please allow a reasonable time for your opt‑out request to be processed. You may still receive messages already in process at the time of your request.


6. How to Get Help

7. Privacy and SMS Consent Sharing

Your use of the SMS Service is also governed by our Privacy Policy, available at:

We use information collected through the SMS Service (including your mobile phone number, message content, and opt‑in/opt‑out records) to:

  • Provide and manage SMS/text communications related to our legal services
  • Maintain records of communications as part of your client file
  • Comply with legal, regulatory, and ethical obligations

We may use service providers (such as telecommunications carriers and SMS platform providers) to transmit and manage SMS/text messages on our behalf. These service providers are permitted to use personal information only to provide services to us.

To meet carrier requirements and for clarity: the information obtained as part of the SMS consent process (including your SMS consent) will not be shared with third parties for their marketing purposes. SMS consent is not shared with third parties.

8. Supported Carriers; Delivery

Delivery of SMS/text messages may be affected by factors outside our control, such as network coverage, your mobile carrier’s services, and device settings. We and the telecommunications carriers:

  • Do not guarantee that messages will be delivered, timely, or error‑free; and
  • Are not liable for any delays, failures, or misdirected delivery of any messages.

Availability of the SMS Service and supported carriers may change without notice.


9. No Emergency Use; Nature of Communications

The SMS Service is intended for general communications related to your legal matters (such as reminders and updates) and is not designed or intended for:

  • Emergency communications or urgent requests that require immediate action; or
  • Transmitting highly sensitive personal information (e.g., Social Security numbers, full financial account numbers, passwords, or health information).

If you have an emergency or time‑sensitive matter, please contact our office by phone and follow any emergency procedures you have been given. For highly sensitive information, we may request that you use more secure channels (such as encrypted email or secure client portals) rather than SMS.

Nothing in these Terms modifies the existence or scope of any attorney–client relationship, which is governed by our Engagement/Legal Services Agreement and applicable law. SMS/text messages may form part of the attorney–client communications once an attorney–client relationship is established.

11. Changes to These SMS Terms & Conditions

We may update these Terms from time to time. When we do, we will update the “Last Updated” date above. Material changes will be posted at https://www.humboldtattorney.com/sms-terms and, where appropriate, we may notify you by SMS/text message or other means.

Your continued participation in the SMS Service after any changes become effective constitutes your acceptance of the updated Terms.


12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles, except to the extent superseded by applicable federal law.
